These Terms of Service ("Terms") govern your use of oakmontshop.com (the "Site") and every purchase you make from Oakmont, operated by Oakmont ("Oakmont", "we", "us"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to enter a binding contract to purchase from the Site.

2. Orders and acceptance

- Your order is an offer to buy. Our order confirmation email acknowledges receipt of your order; the contract is concluded when we ship the items.
- We may refuse or cancel any order, for example in cases of suspected fraud, pricing or stock errors, or resale activity. If we cancel after payment, you receive a full refund.
- You are responsible for entering a complete, correct shipping address at checkout (see our Shipping Policy for the 1-hour correction window).

3. Prices, taxes, and errors

- All prices are in US dollars. Applicable sales tax is shown at checkout before you pay.
- "Compare at" prices reflect the price at which the item was offered on this Site during the preceding 90 days; where an item was not offered at a higher price on this Site in that period, no "compare at" price is shown. Promotions cannot be combined unless stated.
- If a product is listed at a manifestly incorrect price due to a technical or clerical error, we may cancel the order and refund you in full before shipping.

4. Shipping, returns, and refunds

Shipping timelines are described in our Shipping Policy; returns, exchanges, and refunds are governed by our Returns & Refunds Policy. Both are part of these Terms. In short: tracked US delivery typically arriving 7-21 days after shipping, and a 30-day return window from delivery for eligible items.

5. Product information

We work hard to display our products accurately, but screens vary: minor color differences between photos and the physical item can occur, and measurements in size charts are body-measurement guidance, not garment guarantees. This never limits your rights under the Returns & Refunds Policy if an item is defective or materially different from its description.

6. Your account and conduct

If you create an account, keep your credentials confidential; you are responsible for activity under your account. You agree not to misuse the Site, including attempting to breach its security, scraping content, placing fraudulent orders, or infringing others' rights.

7. Intellectual property

All content on the Site (text, product descriptions, photography, graphics, logos, and the "Oakmont" name) is owned by or licensed to us and protected by intellectual-property laws. You may not reproduce or exploit it commercially without our written permission.

8. Disclaimer of warranties

The Site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some states do not allow certain warranty disclaimers, so parts of this section may not apply to you.

9. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to an order or the Site is limited to the amount you paid for the order concerned, and we are not liable for indirect, incidental, special, or consequential damages (such as lost profits). Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including for gross negligence, willful misconduct, or non-waivable consumer rights.

10. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your breach of these Terms or misuse of the Site, to the extent permitted by law.

11. Governing law and disputes

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law rules, and subject to any mandatory consumer protections of the state where you reside.

Any dispute that we cannot resolve informally within 30 days shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and both parties waive the right to participate in a class action. You may opt out of this arbitration clause within 30 days of your first purchase by emailing info@oakmontshop.com. Claims eligible for small-claims court may be brought there instead.

12. Changes to these Terms

We may update these Terms from time to time; the version in force when you place an order applies to that order. The "Last updated" date shows the current version.

13. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remainder stays in force. These Terms, together with the Shipping Policy, Returns & Refunds Policy, and Privacy Policy, are the entire agreement between you and us regarding the Site.
